Brand with Trademark #
A Brand with Trademark is a seller owned or seller controlled brand for which a trademark application has been filed with the relevant trademark authority or for which the trademark has been officially registered.
Trademark Status #
For platform purposes, a brand may be identified as TM Applied where a valid trademark application has been filed and remains pending.
A brand may be identified as TM Registered where the trademark has been officially registered and a valid trademark registration certificate has been issued by the relevant authority.
Sellers must ensure that the trademark status provided to LX INDIA accurately reflects the actual status of the application or registration. A pending application must not be represented as a registered trademark.
Documentation and Verification #
For a pending trademark application, the seller must provide a valid trademark application acknowledgement or receipt containing the applicable application number.
For a registered trademark, the seller must provide a valid trademark registration certificate.
LX INDIA may independently verify the trademark information and may request additional documents or information where necessary. The seller will be permitted to use the applicable trademark classification on the platform only after the submitted information has been successfully verified.
Use of the Registered Trademark Symbol #
The registered trademark symbol ®must not be used unless the relevant trademark has been officially registered.
A pending trademark application does not mean that the trademark is registered. Sellers with a pending application must therefore not use the ® symbol.Following successful verification, an eligible brand may be displayed on LX INDIA
