Category-Specific Regulatory Compliance #
The Seller acknowledges that certain categories of products may be subject to additional regulatory requirements, licences, registrations, certifications, approvals, labelling obligations, and restrictions.
The Seller shall ensure compliance with all category-specific laws applicable to the products listed by the Seller on the Platform.
Food and Nutrition Products #
Sellers offering food, beverages, nutritional products, supplements, or related items shall comply with applicable requirements under the Food Safety and Standards Act, 2006 and regulations issued by the Food Safety and Standards Authority of India (FSSAI).
The Seller shall ensure that:
- valid FSSAI registration/license is maintained wherever required;
- products comply with applicable food safety standards;
- product labels and disclosures are accurate;
- expiry dates, shelf life, ingredients, nutritional information, and mandatory declarations are correctly displayed;
- products supplied to Buyers are safe, genuine, and fit for consumption.
The Seller shall immediately inform LX INDIA upon becoming aware of any product recall, safety concern, regulatory notice, or restriction affecting products listed on the Platform.
Drugs, Cosmetics, Medical Devices and Personal Care Products #
Sellers dealing in medicines, drugs, cosmetics, medical devices, personal care products, or similar regulated categories shall ensure compliance with applicable laws, including:
- Drugs and Cosmetics Act, 1940 and Rules made thereunder;
- Cosmetics Rules, 2020;
- Medical Devices Rules, 2017;
- Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954;
- applicable BIS requirements;
- applicable state and regulatory licensing requirements.
The Seller shall ensure that all required licences, approvals, registrations, and permissions are obtained before listing such products.
The Seller shall not make any false, misleading, unapproved, or prohibited medical, therapeutic, or health-related claims in product listings or promotional content.
LX INDIA shall not be responsible for reviewing, validating, or approving product claims made by Sellers.
Electronics, Electrical Products and Regulated Goods #
Where products require mandatory certification, registration, or compliance approval, including electronic products, electrical appliances, wireless devices, batteries, and related goods, the Seller shall ensure compliance with applicable requirements, including:
- Bureau of Indian Standards (BIS) certification;
- Wireless Planning and Coordination (WPC)/ETA approvals where applicable;
- battery safety requirements;
- electronic waste management requirements;
- energy efficiency requirements;
- environmental compliance obligations.
The Seller shall provide valid compliance documents upon request by LX INDIA.
Imported Products #
For imported goods, the Seller shall comply with applicable import laws and requirements, including:
- Import Export Code (IEC), wherever required;
- importer details;
- country of origin declarations;
- customs requirements;
- applicable product standards.
The Seller shall not conceal, alter, or misrepresent the source, origin, importer details, or compliance status of imported products.
LEGAL METROLOGY AND PRODUCT DISCLOSURES #
The Seller shall ensure that all packaged products listed or supplied through the LX INDIA Platform comply with the Legal Metrology Act, 2009 and the Legal Metrology (Packaged Commodities) Rules, 2011.
The Seller shall ensure that all mandatory declarations required under applicable laws are accurately displayed on product packaging and, where required, on product listings.
The Seller shall ensure that product information does not contain false, misleading, suppressed, or altered declarations relating to:
- product name;
- quantity;
- manufacturer/packer/importer details;
- country of origin;
- manufacturing or packing details;
- MRP and applicable consumer disclosures.
The Seller shall remain solely responsible for compliance with legal metrology requirements applicable to its products.
