Use of the Platform and Seller Responsibilities #

1.You shall not host, display, upload, modify, publish, transmit, update, or in any manner share any information, data, or image that:

• Pertains to or is the property of another person over whom or which you hold no lawful right or authority;
• Is grossly harmful, harassing, defamatory, obscene, pornographic, pedophilic, libellous, invasive of another’s privacy, hateful, or otherwise offensive on grounds of religion, race, ethnicity, or gender; or which promotes, depicts, or encourages bigotry, discrimination, money laundering, gambling, or any unlawful act in any manner whatsoever, including but not limited to content constituting the ‘indecent representation of women’ as defined under the Indecent Representation of Women (Prohibition) Act, 1986;
• Is false, inaccurate, deceptive, or misleading in any material respect;
• Is patently offensive, obscene or otherwise prohibited under applicable law or binding judicial precedent, including content that is sexually explicit or that promotes obscenity, pedophilia, racism, bigotry, hatred, discrimination, or incitement to physical harm or violence against any individual or group;
• Harasses, intimidates, or advocates or incites the harassment, intimidation, or harm of any individual or group of persons;
• Promotes, incites, or encourages any illegal activity or conduct that is abusive, threatening, obscene, defamatory, or libellous in nature;
• Infringes, misappropriates, or otherwise violates any rights of a third party, including but not limited to intellectual property rights, rights of privacy (such as the unauthorised disclosure of a person’s name, email address, physical address, or contact information), or rights of publicity;
• Promotes, distributes, or facilitates the use of any illegal or unauthorised copy of another person’s copyrighted work, including but not limited to providing or sharing pirated software, digital media, or music files, offering links or information intended to circumvent copyright protection mechanisms, or otherwise infringing upon the copyright owner’s exclusive rights;
• Contains restricted or password-protected access pages, hidden pages, images, or URLs that are not accessible through standard navigational links from publicly accessible pages on the Platform;
• Provides, depicts, or promotes material that exploits or abuses any person in a sexual, violent, or otherwise inappropriate manner, or solicits, collects, or attempts to obtain personal information from any individual, particularly minors;
• Provides information, instructions, or guidance that facilitate or enable the commission of unlawful activities, including but not limited to the manufacture, procurement, or use of illegal weapons, the invasion or violation of another person’s privacy, or the creation, distribution, or deployment of malicious software (including computer viruses).
• Contains, displays, or distributes any unauthorised videos, photographs, or images of another individual, whether a minor or an adult, without such person’s explicit consent or legal authorisation;
• Attempts to gain unauthorised access to, or exceeds the scope of authorised access permitted on, the Platform or any part thereof, including but not limited to user profiles, accounts, blogs, communities, bulletins, or communication systems, or solicits, collects, or attempts to obtain passwords, login credentials, or personally identifiable information from other users for commercial, fraudulent, or unlawful purposes;
• Solicits, promotes, or engages in any form of gambling, betting, or wagering activity that we, in our sole and absolute discretion, determine to be, or could reasonably be construed as, illegal, unauthorised, or inconsistent with applicable laws or regulations;
• Engages in, promotes, facilitates, or solicits any form of gambling, betting, or wagering that is prohibited or unauthorised, or that the Platform reasonably determines, in accordance with applicable law and its policies, to be unlawful or not permitted on the Platform.
• Interferes with, disrupts, or hinders another user’s lawful access to or enjoyment of the Platform or any of its services, features, or resources;
• Refers to, links to, or directs users to any website, application, or URL that hosts content which is unlawful, prohibited, or otherwise not permitted under applicable law or the Platform’s policies.
• Infringes, misappropriates, or otherwise violates any patent, trademark, copyright, proprietary rights, trade secrets, or the rights of publicity or privacy of any third party, or is fraudulent in nature, including but not limited to the sale, distribution, or promotion of counterfeit, stolen, or unauthorised goods or materials;
• Harms minors in any way;
• Violates, contravenes, or is otherwise inconsistent with any law, regulation, or legal provision for the time being in force in India or any other applicable jurisdiction;
• Deceives, misleads, or attempts to mislead the recipient or other users regarding the origin, source, or authenticity of any communication, or transmits, publishes, or communicates any information that is grossly offensive, abusive, or menacing in nature;
•  Impersonates another person;
• Contains or distributes software viruses, malicious code, or any computer files, programs, or routines designed to interrupt, damage, destroy, or limit the functionality of any computer system, network, data, or resource, including but not limited to trojan horses, worms, time bombs, cancelbots, easter eggs, spyware, or other harmful components intended to disrupt operations, intercept information, or expropriate data or personal information;
• Threatens, undermines, or is prejudicial to the unity, integrity, defence, security, or sovereignty of India; harms or endangers friendly relations with foreign states; disturbs public order; incites the commission of any offence; obstructs the investigation of any offence; or contains material that insults, defames, or offends any nation or community, including content that violates the Platform’s “Zero Tolerance to Profanity” or “Hurting National and Religious Sentiments” policies;
• Shall, whether directly or indirectly, offer, attempt to offer, trade, or engage in the trade of any goods or services that are prohibited, restricted, or regulated in any manner under any applicable law, rule, regulation, or guideline for the time being in force;

2. You shall not, whether directly or indirectly, publish, or communicate any statement, content, or representation relating to the Platform, LX INDIA, its brand, trademarks, domain name, affiliates, associated entities, or any Sellers that is false, misleading, defamatory, malicious, unlawful, or that misrepresents facts in a manner that may harm reputation or goodwill of LX INDIA or its related entities. Furthermore, you agree not to undertake, permit, or cause any action that places or is likely to place an unreasonable, excessive, or disproportionate load on the infrastructure, systems, or networks of the Platform, LX INDIA, or any connected systems or networks.
3. You shall not forge, alter, or manipulate headers, or any other identifiers with the intent to disguise, conceal, or misrepresent the origin, source, or authenticity of any message, communication, or transmission sent to or through the Platform or any service offered thereon. Furthermore, you shall not falsely claim, represent, or impersonate any other individual, entity, or representative thereof in any manner whatsoever.
4. You shall not use the Platform or any content, material, or service made available thereon for any purpose that is unlawful, unauthorised, or prohibited under these Terms of Use, nor shall you solicit, encourage, or engage in the performance of any illegal act or any activity that infringes upon or violates the rights, interests, or intellectual property of LX India and/or others.
5. You shall, at all times, ensure compliance with all applicable provisions of the Information Technology Act, 2000 and the rules made thereunder, as amended from time to time, as well as all other applicable laws, statutes, rules, regulations, and governmental requirements, including but not limited to those relating to taxation, consumer protection, food safety, legal metrology, customs, foreign exchange, and sector-specific regulatory frameworks.
6. You shall be solely responsible for obtaining, maintaining, and complying with all licences, registrations, approvals, and permits required for your use of the Platform and for the listing, offering, sale, purchase, import, export, or distribution of any goods or services through the Platform.
7. You further agree not to engage, directly or indirectly, in any transaction or activity involving goods or services that are prohibited or restricted under applicable law or regulatory frameworks for the time being in force

Solely to enable LX India to lawfully use, display, store, reproduce, and distribute the information and materials provided by you, and to ensure that no rights of yours are infringed in connection with such use, you hereby grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable, and sub-licensable (through multiple tiers) licence and right to exercise any and all copyright, database, publicity, or other proprietary rights that you may hold in such information. This licence shall extend to the use of such information for any current or future promotional, advertising, marketing, operational, or other legitimate business purposes of LX India, in any form, media, or technology now known or hereafter developed.
9. From time to time, you shall be solely responsible for providing complete and accurate information relating to the goods or services proposed to be listed, offered, or sold by you on the Platform. In this regard, you expressly undertake that all such information, descriptions, specifications, and representations shall be true, correct, and not misleading in any material respect. You further agree that you shall not misstate, exaggerate, misrepresent, or overemphasise the features, quality, functionality, or other attributes of such goods or services in any manner that may deceive, mislead, or cause misunderstanding among users or prospective buyers on the Platform.
10. It is possible that other users (including unauthorised individuals or “hackers”) may post or transmit offensive, obscene, or otherwise inappropriate material on the Platform, and you may be involuntarily exposed to such content. It is also possible for others to obtain personal information about you through your use of the Platform and use such information to harass, harm, or injure you. We do not approve or endorse any such unauthorised use; however, by using the Platform, you acknowledge and agree that we shall not be responsible or liable for any misuse of personal information that you publicly disclose or share with others on the Platform. You are therefore advised to exercise caution and carefully choose the type and amount of information you share or disclose publicly on the Platform.

11. You shall strictly comply with all policies, guidelines, and codes of conduct issued by LX India from time to time, including those relating to ethical business practices and fair competition, and shall not form, participate in, or encourage any cartelisation, collusion, price-fixing, or similar arrangement intended to influence pricing, sales, or any other aspect of business on or in connection with the Platform.
12. You shall ensure that any personal data of customers accessed, collected, stored, or otherwise processed by you is used solely for the purposes authorised under this Terms of Use and in accordance with the permissions provided by LX India and/or the relevant customer. You shall be responsible for implementing appropriate safeguards to protect such personal data and shall remain solely liable for any misuse, unauthorised access, or breach attributable to you.
13. This Terms of Use, together with its annexures and policies referenced herein, constitutes the entire agreement between the parties in relation to its subject matter and supersedes all prior communications or understandings, whether oral or written. LX India reserves the right to modify, amend, or update these Terms of Use from time to time, with such changes taking effect in accordance with the Platform’s notification practices.
