Use of the Platform and Seller Responsibilities #
The Seller agrees to use the LX INDIA Platform only for lawful purposes and in accordance with this Agreement, applicable Seller Policies, and all applicable laws, rules, regulations, and governmental directions.
The Seller shall ensure that all information, content, materials, product descriptions, images, specifications, documents, and communications uploaded or provided through the Platform are accurate, lawful, complete, and do not mislead Buyers or other users.
The Seller shall not upload, publish, transmit, display, or otherwise provide any content or material that:
(a) infringes or violates any intellectual property rights, privacy rights, proprietary rights, or other legal rights of any third party;
(b) is false, inaccurate, misleading, fraudulent, deceptive, or likely to misrepresent the origin, quality, features, specifications, legality, or performance of any product or service;
(c) promotes, sells, distributes, or facilitates any prohibited, restricted, unlawful, counterfeit, stolen, unsafe, or unauthorised goods or services;
(d) contains unlawful, defamatory, obscene, abusive, hateful, discriminatory, threatening, or otherwise prohibited content;
(e) impersonates any person, business, brand, or organisation or falsely represents any relationship, authorisation, dealership, or affiliation;
(f) contains malicious software, viruses, harmful code, or any material intended to interfere with the operation, security, or integrity of the Platform or any connected system.
Compliance with Applicable Laws #
The Seller shall comply with all applicable laws relating to the products and services offered through the Platform, including but not limited to:
- consumer protection laws;
- taxation laws;
- product safety requirements;
- food safety regulations;
- legal metrology requirements;
- intellectual property laws;
- import-export regulations;
- sector-specific licensing requirements;
- data protection and Cybersecurity obligations.
The Seller shall obtain and maintain all licences, registrations, approvals, certifications, and permissions required for the listing, sale, supply, import, export, distribution, or delivery of products through the Platform.
LX INDIA may request supporting documents relating to such compliance at any time.
Seller Product Information and Listing Responsibility #
The Seller shall be solely responsible for providing complete and accurate information relating to products listed on the Platform.
The Seller shall ensure that product descriptions, images, specifications, pricing information, warranty details, certifications, and other disclosures accurately represent the products offered for sale.
The Seller shall not:
- exaggerate product features;
- make false claims;
- conceal material information;
- provide misleading comparisons;
- misrepresent product origin, quality, certification, or performance.
The Seller acknowledges that LX INDIA may review, modify, remove, restrict, or disable listings where LX INDIA reasonably believes that such listings violate applicable law, Platform policies, Buyer safety requirements, intellectual property rights, or Platform integrity requirements.
Such review or action shall not constitute an assumption of responsibility or endorsement of the Seller’s products by LX INDIA.
Prohibited Activities #
The Seller shall not use the Platform to:
- engage in fraudulent activities;
- manipulate ratings, reviews, transactions, or Seller performance metrics;
- create false orders or artificial transactions;
- interfere with another Seller’s business activities;
- attempt unauthorised access to the Platform or other users’ accounts;
- collect or misuse Buyer information;
- bypass Platform security systems or operational controls.
The Seller shall not undertake any activity that may adversely affect the security, functionality, reputation, or lawful operation of the LX INDIA Platform.
Seller Use of Buyer Information #
The Seller acknowledges that any Buyer information, including name, contact details, delivery address, and order-related information provided through the LX INDIA Platform, is made available solely for the purpose of order fulfillment, delivery, customer support, warranty, returns, replacements, and other authorised transaction-related activities.
The Seller shall not use such information for direct marketing, unsolicited communication, promotional purposes, solicitation of business, or to establish any direct commercial relationship with the Buyer outside the LX INDIA Platform. The Seller shall not use the Buyer’s shipping address or contact details for any purpose other than fulfilling the relevant transaction.
Any unauthorised use, disclosure, or misuse of Buyer information, or any attempt to contact Buyers for purposes unrelated to the authorised transaction, shall constitute a material breach of this Agreement and may result in suspension or termination of the Seller Account, without prejudice to any other rights or remedies available to LX INDIA.
Intellectual Property and Seller Content Licence #
The Seller retains ownership of all intellectual property rights in the content uploaded by the Seller, including product descriptions, images, videos, brand identifiers, and other Seller-provided materials (“Seller Content”).
By submitting Seller Content on the Platform, the Seller grants LX INDIA a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, modify, adapt, and use such Seller Content solely to the extent reasonably required for:
- operating and providing Platform services;
- displaying products to Buyers;
- improving Platform functionality;
- promoting Seller products and Platform services;
- complying with legal, regulatory, and dispute-resolution requirements.
The licence granted to LX INDIA shall continue only for the period reasonably necessary for the above purposes, including after account closure where required for legal compliance, record retention, dispute resolution, or operational requirements.
