Limitation of Liability #
To the maximum extent permitted under law, LX INDIA shall not be liable to you for any indirect, punitive, incidental, special, consequential, or other damages whatsoever, including, without limitation, damages for loss of use, data, profits, business, or goodwill, arising out of or in connection with your use of, or inability to use, the Platform, any unauthorised access to data, any breach or misconduct by buyers or manufacturers, Platform unavailability, disputes with buyers, or any other matter relating to the services.
You acknowledge and agree that you use the Platform at your own risk. In any event, LX INDIA’s total aggregate liability to you for all claims arising out of or relating to the Platform or the services shall not exceed the total commission fees actually paid by you to LX INDIA during the three (3) months immediately preceding the event giving rise to the claim.
