Limitation of Liability #
To the maximum extent permitted under applicable law, LX INDIA, its directors, officers, employees, affiliates, representatives, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to:
- use or inability to use the Platform;
- interruption, suspension, or unavailability of Platform services;
- loss of business, revenue, profits, goodwill, or anticipated savings;
- disputes between Buyers and Sellers;
- acts or omissions of Buyers, Sellers, manufacturers, suppliers, logistics providers, or third-party service providers;
- unauthorised access, Cyber incidents, or security breaches not directly caused by LX INDIA’s willful misconduct;
- product defects, quality issues, regulatory violations, or claims relating to Seller products.
The Seller acknowledges that LX INDIA’s role is limited to providing marketplace facilitation services and that LX INDIA does not assume responsibility for Seller obligations.
Subject to applicable law, LX INDIA’s total aggregate liability arising out of or relating to these Terms of Use, the Platform, or the services provided shall not exceed the total commission actually received by LX INDIA from the Seller in respect of the transaction giving rise to the claim.
Nothing in this clause shall limit LX INDIA’s liability where such limitation is prohibited under applicable law or arises due to LX INDIA’s fraud, wilful misconduct, or gross negligence.
